00:46:52.460 --> 00:46:55.710 during the Oil Boom in the 1930s and 40s. 00:46:55.710 --> 00:46:59.710 More recently in the Shale Era, Commissioner Porter, tried 00:46:59.710 --> 00:47:01.950 to focus on the enormous flaring waste 00:47:01.950 --> 00:47:04.030 and pollution in the Eagleford. 00:47:04.030 --> 00:47:06.453 Unfortunately, that effort didn't get far. 00:47:07.510 --> 00:47:10.480 So we're here talking about the problem again today 00:47:10.480 --> 00:47:13.450 because it hasn't been fixed, but a new day means 00:47:13.450 --> 00:47:15.833 a new opportunity to finally get it of routine flaring 00:47:56.660 --> 00:47:59.370 just doesn't reflect our values. 00:47:59.370 --> 00:48:02.980 Nobody likes waste and nobody likes pollution. 00:48:02.980 --> 00:48:05.850 And most folks in and around industry will tell you 00:48:05.850 --> 00:48:08.813 that they don't like routine flaring either, 00:48:09.670 --> 00:48:11.210 but it's not going away because 00:48:11.210 --> 00:48:13.500 we haven't changed the incentives. 00:48:13.500 --> 00:48:16.600 And in this case, we can't change the incentives 00:48:16.600 --> 00:48:19.030 until the Commission acts to change them. due almost entirely 00:48:52.670 --> 00:48:55.340 to intentional decisions to preventing flaring 00:48:55.340 --> 00:48:58.480 in the first place and ensuring a destination 00:48:58.480 --> 00:49:00.350 and use for the gas is in place 00:49:00.350 --> 00:49:03.730 before bringing a well online, and a willingness 00:49:03.730 --> 00:49:06.253 to shut a well in that isn't achieving this. a strange situation going on where 00:52:16.680 --> 00:52:19.870 the TCEQ says, it's the Railroad Commission's job 00:52:19.870 --> 00:52:23.570 to do these flaring permits and the Railroad Commission says 00:52:23.570 --> 00:52:26.550 it's TCEQ's job to make sure they don't violate 00:52:26.550 --> 00:52:27.960 the Clean Air Act. 00:52:27.960 --> 00:52:32.520 But within the very rule itself, rule 32 under B, 00:52:32.520 --> 00:52:35.430 you already say very explicitly that 00:52:35.430 --> 00:52:38.440 you must follow the Clean Air Act. 00:52:38.440 --> 00:52:41.160 And we believe and this is Sierra club's perspective 00:52:41.160 --> 00:52:44.140 that in some cases, some of the flaring permits 00:52:44.140 --> 00:52:46.810 you're giving are violating the Clean Air Act. 00:52:46.810 --> 00:52:50.260 How, because the amount of pollution, 00:52:50.260 --> 00:52:53.290 not the actual methane, but associated byproducts 00:52:53.290 --> 00:52:55.950 like sulfur dioxide and hydrogen sulfide 00:52:55.950 --> 00:52:59.540 are exceeding the permit levels of the very operators. 00:52:59.540 --> 00:53:02.080 And so as a first step, we think there should be 00:53:02.080 --> 00:53:04.740 some sort of a check to make sure the amounts 00:53:04.740 --> 00:53:07.840 and volumes that that are being flared do not 00:53:07.840 --> 00:53:10.130 actually violate the Clean Air Act. 00:53:10.130 --> 00:53:13.540 And we think it's easy to create a check with TCEQ 00:53:13.540 --> 00:53:16.290 to make sure that the amounts that could be flared would 00:53:16.290 --> 00:53:19.670 well after say July 1st, 2020, 01:11:27.810 --> 01:11:30.600 that has no market because of plant capacity 01:11:30.600 --> 01:11:34.610 for its natural gas be placed in an allowable situation.
